1. Introduction
Welcome to the "Ubique Fashion" Mobile App! We are pleased to offer you a unique Fashion Assistance experience. We invite you to carefully read these Terms and Conditions. By using this App, you agree to comply with and be bound by these Terms and Conditions. Therefore, we encourage you to read the following carefully. If you do not accept these Terms and Conditions, please refrain from using the App and the associated services.
Please be informed that these Terms and Conditions apply solely to the use of the Ubique Fashion App (hereinafter referred to as "Ubique" and/or "App") and do NOT apply to goods and services offered by third parties and accessible through the App.
This App is managed by Ubique S.r.l., with registered office at Via Ercole Ferrario 12, Milan 20144, Italy, fully paid share capital of Euro 2,173.90. Registration number with the REA MI – 2588667, Milan Chamber of Commerce, Tax Code and VAT number 11226420963.
2. Services Offered
Ubique Fashion provides personalized fashion assistance services. Users may ask any questions regarding fashion, provide information about what they are looking for, and receive personalized advice and suggestions.
3. Registration and Account
You will need to create an account to use our App’s services, but you are welcome to browse without registration. To create a personal account, users are required to provide truthful and complete information in the relevant form and to fully accept the Privacy Policy and these Terms and Conditions.
Users are authorized to create an account only if they are at least 18 years of age. Users are obliged to safeguard and maintain the confidentiality of the credentials for accessing their personal account. It is understood that in no event shall Ubique be held liable for the loss, dissemination, theft, or unauthorized use by third parties, for any reason, of the access credentials to users' personal accounts.
3.1 Deactivation, Deletion and Closure of the Account
Registered users may deactivate their personal accounts and request deletion at any time by accessing the "Settings" tab, selecting "Account," and following the instructions to deactivate their account. [1] [2]
4. Use of Services
4.1 Interaction with Chat and Chatbot Services
Ubique offers two types of interactive chat services for a seamless shopping experience:

AI-Powered Chatbot: Users can submit a query through Ubique’s AI-enabled chatbot, which promptly displays curated product suggestions from our partner brands and affiliates based on the user’s input. This virtual assistant guides users through their fashion journey, providing tailored responses without direct assistance, and refines suggestions based on individual preferences. The AI system processes user-provided information and, through an algorithm, shares it with OpenAI’s artificial intelligence to generate responses and suggest suitable options. OpenAI, however, nor use chats to train the model. The AI-Powered chatbot will assist users in finding the best pairings available from Ubique's partner and affiliate vendors (hereinafter referred to as "Partners" and/or "Vendors"), which users can view in the "My Qurations" section. Through the aforementioned section, users will be able to select items, chat directly with Vendors, and receive real-time assistance to complete purchases or book appointments in-store. Please note, however, that responses generated through artificial intelligence may be subjective and may occasionally contain errors or bias.

Live Support Chat: For more personalized support, users can interact directly with Ubique’s consultants or connect with specific brand partners through a live chat option. This feature enables real-time, 1-to-1 consultations with Ubique’s team or vendor representatives, offering a customized shopping experience. Some product listings may also feature direct chat options, allowing users to reach out to brand partners for further guidance.

4.2 Store Locator
The App includes a store locator service that displays fashion stores on a map along with their contact information, allowing users to reach out or chat directly with them for inquiries.
If users want to find nearby stores, they will be prompted to enable location access, which can be adjusted anytime in device settings.
5. Services Provided by Vendors and link
Ubique operates solely as an intermediary and is not a party to the contractual relationship between the user and the Vendor. Although the App allows access to or utilization of services offered by Partners, these are not considered "Services" within the meaning of these Terms and Conditions and are not subject to any guarantee, service commitment, or other obligations by Ubique. It is understood that Ubique shall in no event be held liable with respect to the quality, characteristics, and/or availability of the products and services offered by Partners.
ANY DISPUTE RELATING TO PURCHASES MUST BE RESOLVED BETWEEN THE USER AND THE VENDOR.
It is possible that the Vendor shares links to their website or other external links within the chat. You may choose at your own risk to visit an external site. All links to external sites (including those of our Partners) are not governed by these Terms and Conditions.
UBIQUE IS NOT RESPONSIBLE, EITHER DIRECTLY OR INDIRECTLY, FOR THE CONTENT, TRUTHFULNESS, OR QUALITY OF THE GOODS AND/OR SERVICES OFFERED THROUGH EXTERNAL LINKS.
6. Intellectual Property
The contents available on the App, including but not limited to photographs, images, articles, and illustrations ("Contents"), may be used and accessed by users only within the limits specified in this clause. Users are expressly prohibited from copying, downloading, sharing, modifying, publishing, transmitting, selling, sub-licensing, processing, transferring/assigning to third parties, or creating derivative works in any manner from the Contents, including those of third parties, available on the App, nor may they permit third parties to do so.
Users acknowledge that the registered and unregistered trademarks of Ubique and any derived names, the format, and the graphical interface of the App, as well as the Contents, are the exclusive property of Ubique, and they acknowledge that all other distinctive signs, trade names, service marks, trademark names, business names, illustrations, images, and logos pertaining to the Partners and the content published by such Partners are and remain the exclusive property or under the control of the respective owners and are protected by applicable intellectual property laws.
7. Representations, Warranties, and Limitation of Liability
THE SERVICES OFFERED THROUGH THE APP ARE PROVIDED "AS IS" AND "AS AVAILABLE." UBIQUE MAKES NO REPRESENTATIONS, NOR CAN IT MAKE ANY, ABOUT THE CONTENT OR FUNCTIONALITY OF SUCH SERVICES.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, UBIQUE DOES NOT GRANT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, RELATING TO THE SERVICES, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. IN PARTICULAR, UBIQUE DOES NOT REPRESENT OR WARRANT THAT (A) ITS SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, (B) ANY DEFECTS OR ERRORS IN THE SERVICES WILL BE IDENTIFIED OR CORRECTED, OR (C) ALL CONTENT OR INFORMATION OBTAINED BY THE USER ON OR THROUGH THE SERVICES WILL BE ACCURATE, COMPLETE, UPDATED, OR SUITABLE FOR THE USER'S PURPOSES.
WE DO NOT ASSERT OR WARRANT THAT THE APP IS IMMUNE FROM VIRUSES OR OTHER HARMFUL ELEMENTS. IN THIS REGARD, YOU SHOULD TAKE YOUR OWN PERSONAL PRECAUTIONS. IN ANY CASE, WE SHALL NOT BE LIABLE FOR SERVICE INTERRUPTIONS CAUSED BY CYBER ATTACKS LAUNCHED SIMULTANEOUSLY FROM MULTIPLE SOURCES OR BY VIRUSES OR OTHER TECHNOLOGICALLY HARMFUL ELEMENTS THAT MAY INFECT YOUR EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER MATERIALS AS A RESULT OF YOUR USE OF OUR APP.
WE DISCLAIM ANY RESPONSIBILITY FOR THE FAILURE TO MAINTAIN THE APP.
TO THE EXTENT PERMITTED BY LAW, UBIQUE SHALL NOT BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE APP OR THE INABILITY TO USE IT. THE USER AGREES TO USE THE APP AT THEIR OWN RISK.
8. Dispute Resolution
In the event of disputes related to these Terms and Conditions, the parties agree to resolve them amicably. Therefore, if for any reason you are dissatisfied with our services, we first invite you to contact our customer service by writing to info@ubiquefashion.com.
The European Commission also provides an online dispute resolution platform available at http://ec.europa.eu/odr.
Should it not be possible to reach an agreement, the dispute shall be submitted to the non-exclusive jurisdiction of the Italian courts.
9. Applicable Law
These Terms and Conditions and the services rendered through the App are governed by Italian law.
10. Modifications to the Terms and Condition
In compliance with applicable laws, we reserve the right to modify, correct, or change the Terms and Conditions at any time. Notification of any substantial changes will be published on this page with an updated effective date. In certain cases, we may notify the user of a modification via email or other means; however, the user is required to regularly consult this page to verify whether any changes are present. Access to or continued use of our services by the user constitutes their consent to any modifications and, consequently, to be legally bound by the updated Terms and Conditions. If the user does not accept a modification to the Terms and Conditions, they must immediately cease access to or use of our services.
